Mini Hogbetsotso Za in limbo as Torgbi Nyaho Tamakloe VI sues the organisers for not following due process- DETAILS!

The Fiaga of Whuti and Miafiaga of the Anlo State in the Volta Region of Ghana, Torgbi Nyaho Tamakloe VI, has officially instituted legal proceedings against some chiefs and community leaders from Alakple with regard to the celebration of this year’s Mini Hogbetsotso Za and a chieftaincy nomination process. 

The lawsuit which was filed on Friday, 27th September, 2024, at the Denu High Court of Justice, was done through his legal representatives. He wants an interlocutory injunction placed on the festival as due process had not been followed. Some prominent figures cited as defendants are: Awadada Agbesi Awusu II, Torgbi Amey Zegu II, Major General (Rtd) Dumega Henry Anyidoho, former Member of Parliament Hon. Dumega Clement Kofi Humado, and the President of the Volta Regional House of Chiefs, Dumega Frank Dagbui.

Other defendants spotted in the lawsuit include: Dumega Bernard Wisdom Quarshie, Agbotadua Fianu, Mr. Frederick Kwabla Penu,

Dumega Augustine Kofi Kudese, Dumega Mensah Peter Dagbui, Rev. Elikem Joachim, Mr. Paul Atsu Deyegbe, WO1 Vincent Tettey (Retired), Madam Evelyn Deamesi, Mr. Felix Deyegbe, Torbokor Nyatefe Kudese, Prof. Wisdom Akpalu, Nyonudada Janet Kporku, Dr. Mrs. Paulina Dzoyi, Mr. Gilbert Dagbui and Madam Helen Avenor. 

In the writ, the Miafiaga of the Anlo State who also doubles as the Fiaga of Whuti, was not happy with the fact that he was not involved in the planning process as far as the selection of the venue for the Mini Hogbetsotso Za is concerned. In his words, the act has brazenly breached traditional protocol since Torgbi Amey Zegu II, Dufia of Alakple, has no locus to superintend over such a high profile process without his approval. 

STATEMENT OF CLAIM

The Plaintiff’s claim is for:

  •    A declaration that the signing of the chieftaincy nomination form by the 1st and 2nd Defendants for the installation of Torgbi Kpodo Adzi IlI is a usurpation of Plaintiff’s administrative mandate as Flaga (Paramount Chief) of Kome-Shime.
  •    An order setting aside the said chieftaincy nomination form.
  •    A declaration that the planning of the mini Hoghe by 1″ Defendant to be celebrated in Alakple within the Kome-Shime paramountey without the prior consent, approval and/ or the involvement of the Plaintiff is wrongful.
  •    An order of perpetual injunction to restrain the Defendants, their privies, assigns and anybody working with them or through them from going ahead with the intended celebration.
  •    Costs.
  •    Any other order(s) that this Honorable Court shall deem fit as necessary on the face of the pleadings and/or arising in the course of the trial.

The Mini Hogbetsotso Za, is scheduled to take place on 26th  October, 2024, in Alakple. The defendants, however, have eight days to respond to the writ.
